1. Acceptance of the Terms
By accessing and using the Dialogia application, you agree to be bound by these Terms and Conditions of Use. If you do not agree to these terms, you must not use this application.
Who can accept these terms
These terms are accepted by whoever contracts the service or opens a teaching-staff or management account, and doing so requires the legal capacity to be bound: being an adult, or acting on behalf of a school or an organization with sufficient authority to do so.
Students do not accept these terms, and are not asked to. Dialogia Questions students do not accept them: they get in with a class code and no account. Dialogia Classroom students do not accept them either: their account is created by their school. Whoever contracts the service is the school or the teacher, and they are the one who takes on these terms. Asking a minor to accept a contract they cannot sign would be an empty gesture, so we do not do it.
Dialogia does not ask anyone their age. When a school or a teacher creates a course, they declare its educational stage, and the relevant protections follow from that; no date of birth is ever collected. By declaring that stage, the school confirms that using the platform with its students is authorized under whatever educational and data protection rules apply to it, and that it has informed families wherever it is required to.
When these terms change
These terms carry a version and a date. When we publish a new version that materially affects the rights or obligations of whoever uses the platform, the platform tells you when you log in and asks you to accept it; until you do, we keep applying the previous version wherever it benefits you. We keep a record of which version each account accepted and when, because we are the ones who have to prove we gave notice.
2. Description of Service
Dialogia is an educational platform that uses artificial intelligence to transform course materials into interactive knowledge. The service is designed for educators, trainers, speakers, and other educational professionals who wish to enhance their teaching through AI-powered tools.
Our platform enables users to upload educational content, generate interactive learning materials, and provide AI-assisted responses to student inquiries.
3. User Accounts and Registration
To use Dialogia, you must create an account by providing accurate and complete information. You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
- Notifying us immediately of any unauthorized use
- Ensuring your contact information remains current
Classroom student accounts are created by the school, not by students themselves. Whoever creates them is responsible for the accuracy of the data they enter and for there being a legitimate basis to add that person to the platform. Dialogia Questions does not create any student accounts: you get in with a class code and no data is requested.
4. Acceptable Use
You agree to use Dialogia only for lawful educational purposes. Prohibited uses include:
- Uploading harmful, offensive, or illegal content
- Attempting to interfere with the platform's operation
- Using the service to harass or harm others
- Violating intellectual property rights
- Sharing account access with unauthorized users
- Using the platform for commercial purposes outside of education
Reasonable AI use. The AI assistant included with each account has a monthly usage limit, set in the same unit the product is billed by (Clause 3 of the Contracting Terms): per course in Dialogia Questions, shared by everyone enrolled in it; per student account in Dialogia Classroom. It is a limit on AI spending, not on access to the platform in general, and it exists so that disproportionate use by a single account does not exhaust, at everyone else's expense, the AI allowance for an entire course or for all the students an institution has contracted for.
Once reached, the AI assistant stops responding until the start of the following calendar month. This is not a technical error or a service outage: the rest of the platform — course materials, the working document, submissions already made — keeps working normally, and whoever hits the limit gets a clear notice explaining what happened, in their own language, instead of a generic error. In Dialogia Questions, the question that could not be answered is also logged and remains visible to the teacher in the existing questions panel.
The limit can be raised: by talking to the institution or whoever administers the account, or by writing to hello@dialogia.org.
5. Content and Intellectual Property
You retain ownership of the educational content you upload to Dialogia. By using our service, you grant us a license to process your content into knowledge pills for educational purposes. What happens to the original file depends on the product: see clause 6 for details.
You represent and warrant that you have the right to upload and use all content you provide, and that such content does not violate any third-party rights.
Dialogia retains ownership of the Dialogia platform, including all software, features, and AI-generated educational materials created through our service.
6. Privacy and Data
Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your information.
Data control: You can delete a course at any time from your course list. What happens depends on the product: in Dialogia Questions, deleting a course permanently removes the original files you uploaded and the knowledge pills generated from them; the course and its classes are kept flagged as deleted — no longer visible — so the record of questions already logged is not lost. In Dialogia Classroom, deleting a course removes it from view immediately and its content is destroyed at the next retention purge: at the end of the school year if the course has students under 18, and at 48 months otherwise. The original materials of a deleted course go with it.
Deleting your account is a separate action. If you signed up yourself, you can delete it from your settings. If your account is managed by a school, the school manages it: in that relationship the school is the data controller, and your courses and students belong to it. And if you have an active subscription, that has to be settled first — we will tell you why, not just show you an error.
File processing: Text is extracted from course materials as soon as they are uploaded, to generate knowledge pills. In Dialogia Questions, the original file is automatically removed from our servers once that extraction succeeds; if it fails, the file is kept so you can retry. In Dialogia Classroom the original file is kept for as long as the course exists, and is not deleted right after its text is extracted: it is needed to reprocess the material if it changes or if extraction improves. When the course is deleted, its originals go at the next retention purge.
Question records: Student question records are kept in pseudonymized form — linked to a browser identifier, never to a name — as part of the service and for the periods set out in the Privacy Policy. For research and platform improvement, only aggregated, anonymous statistics are used, which contain neither the text of any question nor any identifier. The identifier is random and different for each class: the records cannot be linked to an identity or across classes.
7. Service Availability
While we strive to maintain high availability, Dialogia is provided "as is" and we do not guarantee uninterrupted access. We may modify, suspend, or discontinue the service with reasonable notice when possible.
8. Limitation of Liability
To the maximum extent permitted by law, Dialogia shall not be liable for:
- Indirect, incidental, or consequential damages
- Loss of data, profits, or business opportunities
- Service interruptions or technical failures
- Third-party actions or content
Nothing in this section limits any non-waivable rights. If you use the platform as a consumer or user, no exclusion or limitation in these terms affects the rights that consumer-protection law grants you on a non-waivable basis, nor the liability that the law does not allow to be excluded or limited.
9. Indemnification
You agree to defend, indemnify, and hold harmless Dialogia from any claims, damages, or expenses arising from your use of Dialogia, your content, or your violation of these terms.
10. Termination
Either party may terminate your account at any time. We may suspend or terminate your access for violations of these terms. Upon termination:
- Your access to Dialogia will be immediately revoked
- Your account data will be deleted according to our Privacy Policy
- These terms will continue to apply to any remaining obligations
11. Changes to the Terms
We may update these Terms and Conditions periodically. Each version carries its own date, and the one in force is the one you see on this page.
Changes that materially affect your rights or obligations are accepted expressly, not simply by continuing to use the platform: the next time you log in, you will see what has changed and be asked to accept it. Minor changes — wording corrections, clarifications that do not alter what was agreed — are communicated by email or through a notice on the platform, and continued use is enough for them to be considered known.
If you do not accept a new version, you can stop using the service and request to cancel; if you had an active paid subscription, whatever the Contracting Terms provide will apply.
12. Governing Law
These terms are governed by Spanish law. If you use the platform as a consumer or user, any dispute will be resolved before the courts and tribunals of your place of residence, and you retain in full the rights that consumer-protection law grants you. If you contract as a business, an educational institution, or an organization, the parties submit to the courts and tribunals of Bizkaia — the same criterion as the Contracting Terms.
